AGREEMENT


By contributing code, keyboard changes or any other work to the FirstVoices Keyboards repository, you agree to the following:

  1. You grant our organization a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable license that applies to all your relevant intellectual property, copyright, and patent: allowing our organization to reproduce, prepare derivative works of, publicly display, publicly perform, sublicense, modify, and distribute the work and such derivative works in Source or Object form, with no limitation or restrictions to the nature of that distribution. This distribution includes (but is not limited to) sharing the work with a community, language authority or individual representing a community, as our organization deems appropriate. Your contribution will not modify the existing copyright notice or license in any way, unless explicitly agreed upon by all parties.

  2. You accept that your contribution will be acknowledged at our organization's discretion and in an appropriate way. In most cases, this will be done by accepting your contribution on a public platform (e.g. Github), or including your name alongside your changes in the source-code change log (e.g. HISTORY.md). While we are committed to ensuring your contribution is recognized, our organization will be under no obligation to 1) promote or acknowledge your contributions in any way, 2) to promote or acknowledge your contribution in all derivative formats.

  3. The contribution you are submitting is your original work, and you are able to grant us the rights specified in this agreement. If your employer has rights to your intellectual property, you acknowledge that you have received permission to grant us these rights or that the employer has waived these rights in relation to this contribution. If your contribution includes 3rd party work that you are allowed to include, you must ensure that is explicitly noted in your contribution's submission and that the appropriate license is included.

  4. In no event and under no legal theory, whether in tort (including negligence), contract, or otherwise, unless required by applicable law (such as deliberate and grossly negligent acts) or agreed to in writing, shall you be liable to our organization for damages, including any direct, indirect, special, incidental, or consequential damages of any character arising as a result of this agreement or out of the use or inability to use the work (including but not limited to damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses).

  5. You are providing our organization with your work 'AS IS' and are not expected to provide support or updates to your work unless you choose to do so.

  6. Our organization is under no obligation to accept your code or contribution, and this agreement does not guarantee that your contributions, in part or in whole, will be included in our products.

 


DEFINITIONS


  • "FirstVoices Keyboards repository" refers to the folder containing FirstVoices Keyboards in the Keyman repository (currently 'fv' in repository keymanapp/keyboards), hosted in an open-source online repository (currently Github).

  • "Our Organization" shall refer to the First Peoples' Cultural Council and First Peoples’ Cultural Foundation (FPCF), as the owners and operators of the FirstVoices platform and FirstVoices Keyboards software.

  • "Source" form shall mean the preferred form for making modifications, including but not limited to software source code, documentation source, and configuration files.

  • "Object" form shall mean any form resulting from mechanical transformation or translation of a Source form, including but not limited to compiled object code, generated documentation, and conversions to other media types.

  • "Contribution" shall mean any work of authorship, including the original version of the work and any modifications or additions to that work or derivative works thereof, that is intentionally submitted to our organization by the copyright owner or by an individual or legal entity authorized to submit on behalf of the copyright owner. For the purposes of this definition, "submitted" means any form of electronic, verbal, or written communication sent to our organization or its representatives, including but not limited to communication on source code control systems, and issue tracking systems that are managed by, or on behalf of, our organization for the purpose of discussing and improving the work, but excluding communication that is conspicuously marked or otherwise designated in writing by the copyright owner as "Not a Contribution."
